Terms & Conditions
1. General
These Terms and Conditions apply to all processing, anodizing, finishing, and related services
performed by Upstate Anodize (“Supplier”). Submission of parts for processing constitutes
acceptance of these terms unless otherwise agreed to in writing.
2. Racking and Contact Marks
- Rack and contact marks may be present on finished parts and are considered acceptable
unless otherwise specified by the customer in writing or on the applicable drawing. - Supplier will rack parts using industry-recognized best practices; however, final rack locations are at the Supplier’s discretion unless specifically designated by the customer
- Customers are responsible for identifying any areas where rack marks or contact points are
prohibited.
3. Surface Condition and Appearance
- Final appearance is dependent upon the base material, alloy composition, heat treatment,
surface finish, machining methods, and prior manufacturing processes. - Anodizing and related finishing processes will not conceal or correct existing scratches,
tool marks, machining marks, pits, inclusions, welds, dents, stains, or other surface
imperfections. - Cosmetic appearance may vary between lots and individual parts due to differences in
material composition and processing history.
4. Color Variation
- Some aluminum alloys and manufacturing processes may result in color variation after
anodizing. - Variations in shade, tone, gloss, and color consistency are normal and may occur due to
alloy composition, part geometry, material condition, and processing variables. - Color matching cannot be guaranteed unless otherwise agreed to in writing.
5. Alloy and Process Limitations
- Certain alloys and manufacturing processes are not recommended for dyed anodizing
and/or hardcoat anodizing due to their material characteristics. - The customer is responsible for verifying material suitability for the intended finish prior to
submission. - Supplier reserves the right to advise against processing materials that may not produce
acceptable results.
6. Hardcoat Anodizing Recommendation
- To reduce the risk of burning and other coating defects, hardcoat anodizing of 2000-series
aluminum alloys is not recommended above a total coating thickness of 0.001 inch (1 mil). - Requests exceeding this recommendation will be processed only at the customer’s risk
unless otherwise agreed in writing.
7. Inspection and Acceptance
- Customers shall inspect all processed parts upon receipt and notify Supplier of any
claimed nonconformance within a reasonable period after delivery. - Failure to provide timely notice shall constitute acceptance of the processed parts.
8. Limitation of Liability
- Supplier’s liability for any claim arising out of the services performed shall be limited to the
value of the processing charges applicable to the affected parts. - Supplier shall not be liable for any indirect, incidental, special, punitive, or consequential
damages, including but not limited to production delays, loss of use, lost profits, loss of
business opportunities, product recalls, or customer-imposed penalties. - Under no circumstances shall Supplier’s total liability exceed the amount paid for the
processing services performed on the affected parts.
9. Warranty Disclaimer
- Supplier warrants only that services will be performed in accordance with generally
accepted industry standards. - Except as expressly stated herein, no other warranties, express or implied, including
warranties of merchantability or fitness for a particular purpose, are provided.
10. Governing Terms
Any modification to these Terms and Conditions must be agreed to in writing by an authorized
representative of Upstate Anodize.
